Donald B. Hoyt, BYBR's litigation partner, assisted in the representation of a York City Police Officer in Federal Court at the beginning of November. The trial in Harrisburg involved defending an officer who was accused of violating a woman’s constitutional rights during an arrest. She alleged that the officer used excessive force in the arrest. The jury found in favor of the police officer saying that he did not violate her constitutional rights.
in the second case, Attorney Hoyt obtained a Plaintiff’s personal injury verdict in the York County Court of Common Pleas. Attonrey Hoyt represented an African-American private duty nurse who was verbally abused by her employers, including the use of racial epithets. She sought damages for intentional infliction of emotional stress. Although the Defendants denied all allegations, the jury found that the wife committed intentional infliction of emotional stress on the nurse and awarded her $85,000.00 in compensatory damages. In addition, the jury found that the wife’s conduct was outrageous and awarded the nurse $50,000.00 in punitive damages. This is the first case in York County to go to a verdict on this type of claim, and it may be the first case in Pennsylvania that has gone to verdict on this type of claim.
