The increasing frequency
of separation and divorce has drastically increased the volume of
cases in which custody of children is at issue. No issue can be more
important than the well-being and best interests of a child. Often
parents are able to agree on scheduled visitation and access for their
children. But whether there is an amicable agreement or there are
contested issues of custody, experienced representation is essential.
The touchstone legal principle involved in custody and visitation
cases is the best interest of the child. When we are hired, we keep
that concept foremost in our minds. And we know that a prolonged,
often hostile court battle is rarely good for children. So we try
to resolve custody cases amicably, if at all possible. They can
often be settled with good faith discussions, conciliation or mediation.
But if they cannot be resolved amicably, we are prepared to aggressively
litigate custody issues.
We have many years of involvement in custody cases, as judge, master
and mediator. We know the law and can offer a unique insight into
what the Court may do in a given situation. This makes discussion
a lot more meaningful.
We prepare our cases for consultation professionally and carefully.
Even though these are very emotional issues, we will calmly explain
the law and work with our clients to get the best results for their
children.
